Grandparent Rights
Grandparents do have rights under Texas family law, but it is not easy to assert those rights. You WILL need a lawyer to help you. Grandparents can file for custody of a grandchild if they can make a case that it is in the child’s best interest (such as cases of child abuse or when a parent is incompetent or in jail).
Grandparents can seek visitation with a child if the child’s parents are divorced, but the grandparent does not have an absolute right to visitation if the parents do not agree.
